For Sale By Owner (FSBO) homes account for a small fraction of sales, and the data consistently shows that agent-represented homes sell for more money, even after accounting for compensation. Is FSBO Legal in Georgia?

Yes, it is perfectly legal to sell your own home in Georgia without a real estate agent. You are not required to use a licensed agent to sell your primary residence. However, you are still subject to all of Georgia's real estate laws, disclosure requirements, and contract standards. Selling without a license does not exempt you from the rules.

What You Miss Without an Agent

MLS Access

Only licensed agents can list properties on the First Multiple Listing Service (FMLS) in Georgia. Without MLS access, your home does not appear on Zillow, Realtor.com, Redfin, or any of the major real estate sites that buyers use to find homes. You can list your home on Facebook Marketplace or Craigslist, but you miss the vast majority of the buyer pool. This is the single biggest disadvantage of FSBO.

A professional listing includes high-quality photography, video walkthroughs, dedicated listing websites, social media promotion, and targeted digital advertising. Most FSBO sellers rely on cell phone photos and a Facebook post. The difference in presentation is dramatic, and buyers notice.

Buyers agents are trained negotiators. When you sell FSBO, you are negotiating directly against a professional who does this every day. They know what to ask for, what to push back on, and how to structure a deal that favors their buyer. Without an agent on your side, you are at a distinct disadvantage.

Legal Protection

Georgia's purchase agreement is a legally binding contract with serious consequences for mistakes. One missed deadline, one improperly filled form, or one undisclosed defect can lead to lawsuits, lost deposits, or a deal that falls apart. Georgia-Specific Requirements

If you do sell FSBO in Georgia, you must comply with these requirements:

  • Seller's Property Disclosure Statement. Georgia requires sellers to disclose known material defects in the property. Failure to disclose can lead to legal liability after the sale.
  • Attorney-closing process. Georgia is an attorney-closing state. Both buyer and seller typically have their own attorneys who handle the closing, and the seller pays for the attorney. You still need a real estate attorney even without an agent.
  • Transfer tax and closing costs. Georgia charges a documentary stamp tax of $1 per $1,000 of the sale price, paid by the seller. You also pay prorated property taxes, HOA fees, and other closing costs.

The median sale price for agent-represented homes is typically 10% to 20% higher than FSBO sales. On a $400,000 home, that difference is $40,000 to $80,000.   • Handling negotiations poorly. Without a real estate agent, you are negotiating against a buyer's agent who does this every day. It is not a fair fight.
  • Paperwork mistakes. One incorrect clause or missed deadline can kill a deal or create legal liability. Georgia's purchase agreement is not a DIY document.

When FSBO Might Work
